These Terms & Conditions govern all work carried out by James Lewis Web Design ("I", "me", "my") for clients ("you", "your"). By commissioning work, you agree to these terms. If anything isn't clear, ask before we start.
1. The work
The scope of work will be agreed in writing before any project begins - either via email or a written proposal. Any additions to the agreed scope during the project may result in additional charges, which will be communicated and agreed before the extra work is carried out.
2. Payment
All projects are split into two payments: 50% upfront to begin work, and 50% on completion before the site goes live. For larger Pro projects, a three-payment schedule can be arranged - this must be agreed in writing before work starts. Invoices are due immediately at the time of issue. Late payments may result in work being paused until the outstanding balance is cleared. Continued non-payment may result in the project being cancelled - in all cases the deposit payment is non-refundable. All prices are quoted in GBP and are exclusive of VAT (where applicable).
3. Revisions
Each package includes a set number of revision rounds:
- Essential: 1 round of revisions
- Growth: 2 rounds of revisions
- Pro: Unlimited revisions within the agreed scope
A revision round means one consolidated set of changes submitted together - not a rolling series of individual requests. Additional revision rounds beyond the included amount will be charged at an agreed hourly rate.
4. Your responsibilities
To keep projects on schedule, you agree to:
- Provide all required content, logos, images and information promptly when requested
- Give feedback and approvals within a reasonable timeframe - typically 3–5 working days
- Ensure any content you provide does not infringe third-party intellectual property rights
- Have the authority to commission and approve the work on behalf of your business
Delays caused by late content or feedback may push back the agreed timeline. The 14-day turnaround applies from the point all required content has been received.
5. Intellectual property & ownership
Once the final payment has been received, full ownership of the completed website design and content passes to you. You own it outright.
Until final payment is made, all work remains the intellectual property of James Lewis Web Design and may not be used, published or transferred.
I reserve the right to display completed work in my portfolio, on social media and on this website, unless you specifically request otherwise in writing before the project begins.
6. Hosting & third party services
All websites are built on Webflow. Webflow hosting is a separate subscription billed directly to you by Webflow — this is not included in my project fees unless you are on a support package that includes hosting.
I am not responsible for downtime, data loss or changes made by third-party platforms including Webflow, Google, or any integrated services. I will always do my best to help resolve issues but cannot guarantee the behaviour of third-party services.
7. Support Packages
Support packages (Maintenance and Growth) are month-to-month subscriptions with no minimum term. You can cancel at any time with 30 days' written notice. No refunds are given for partial months.
Support packages cover the services listed in the package description at the time of purchase. Work outside the scope of the package will be quoted separately.
8. Cancellation
If you wish to cancel a project after work has begun, you must notify me in writing. The deposit (50% upfront payment) is non-refundable. If work has progressed beyond the deposit stage, a fair charge for work completed to that point will apply.
I reserve the right to cancel a project if a client is abusive, persistently late with payments, or acts in bad faith. In this case, a fair charge for work completed will be invoiced and any remaining balance returned.
9. Limitation of liability
My total liability to you in connection with any project will not exceed the total fees paid for that project. I am not liable for any indirect, consequential or economic losses arising from the use or inability to use a website I have built, including but not limited to loss of business, revenue or data.
10. Governing law
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
